1. Acceptance of Terms

1.1 By accessing or using Picovate you represent that you have the legal capacity to enter into a binding agreement.

1.2 We may modify these Terms at any time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after any change constitutes your acceptance of the updated Terms.

2. Description of Service

2.1 Picovate allows you to upload a photo, which is then up‑scaled, restored, and optionally colorized (the "Restoration").

2.2 The restoration is performed using third‑party AI image generators. Because AI‑based processing is probabilistic, results may vary and we make no guarantee of a specific quality, accuracy, or aesthetic outcome.

2.3 The colorization feature for black‑and‑white images is experimental; outcomes are likewise variable.

3. Credits & Billing

3.1 Purchasing Credits – All credit purchases are processed through the Stripe payment gateway. By completing a purchase you authorize us to charge the payment method you provide.

3.2 Credit Deduction – One (1) credit is deducted immediately after a restoration job finishes, irrespective of whether you click the download button.

3.3 No Refunds – Credits are non‑refundable, except as required by law or as expressly stated in a separate written agreement.

3.4 Expiration – Credits do not expire as long as your account remains active.

4. Photo Handling & Immediate Download Requirement

4.1 No Storage – We do not retain copies of your original or processed photos beyond the time needed to complete the restoration.

4.2 Immediate Download – Once the restoration finishes, you will be presented with a large "Download" button and a prominent notice that reads:

"Don't forget to download your image."

You must click this button before the page is closed or you navigate away. If you fail to download the image at that moment, the processed file will be permanently deleted and cannot be recovered. You will still be charged 1 credit for the completed restoration.

4.3 Security – While we employ industry‑standard security measures, you acknowledge that transmitting images over the internet carries inherent risks and we are not liable for any unauthorized access that occurs outside of our control.

5. Payments

5.1 All payments are processed exclusively by Stripe. We do not store your payment information.

5.2 You are responsible for any fees, taxes, or charges imposed by your bank or payment provider.

5.3 In the event of a disputed charge, you must contact us through the Contact page before initiating a chargeback.

6. User Conduct

You agree not to:

• Upload images that you do not own or have not obtained proper permission to use.
• Use the Service for illegal, defamatory, obscene, or otherwise inappropriate purposes.
• Attempt to reverse‑engineer, decompile, or otherwise tamper with the underlying AI models or code.

Violations may result in immediate suspension or termination of your account, forfeiture of credits, and any other remedies available under law.

7. Intellectual Property

7.1 Your Content – You retain all rights to the original photos you upload. By uploading, you grant Picovate a worldwide, royalty‑free, non‑exclusive license to process the images solely for the purpose of providing the Service.

7.2 Resulting Images – Upon successful restoration and your download, the output image is owned by you. You may use, reproduce, or distribute it as you wish, subject to these Terms and any applicable law.

7.3 Our IP – All software, code, designs, trademarks, and other materials belonging to Picovate remain our exclusive property. No portion of the Service may be copied, modified, or used for commercial purposes without our prior written consent.

8. Disclaimer of Warranties & Limitation of Liability

8.1 As‑Is – The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non‑infringement.

8.2 Result Variability – Because the Service relies on AI models, we do not guarantee any specific result, quality, or performance.

8.3 Limitation – To the maximum extent permitted by law, Picovate, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, or use, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

8.4 Maximum Liability – Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you have paid to Picovate for credits in the twelve (12) months preceding the claim.

9. Termination

9.1 You may terminate your account at any time by contacting Support. Upon termination, any remaining credits are forfeited.

9.2 We may terminate or suspend your access immediately, without notice, for any breach of these Terms or for any conduct that we deem harmful to the Service or other users.

We will make reasonable efforts to respond within a reasonable timeframe.

11. Governing Law & Dispute Resolution

11.1 These Terms are governed by the laws of the United Kingdom, without regard to its conflict‑of‑law principles.

11.2 Any dispute arising out of or relating to these Terms shall be resolved exclusively in the courts of the United Kingdom, and you hereby consent to the jurisdiction of such courts.

12. Miscellaneous

• Entire Agreement – These Terms constitute the entire agreement between you and Picovate regarding the Service and supersede all prior understandings.
• Severability – If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver – Failure to enforce any right under these Terms does not constitute a waiver of that right.
